Pool Permit and HOA Approval Process Explained

Part 5 of 10: Pool Ownership 101

Permitting and HOA approval are two separate processes that often run in parallel, and confusing one for the other is a common source of project delays. Gleannloch Farms routes pool and backyard plans through its HOA architectural review, and golf-course-adjacent lots there need drainage planned so runoff moves correctly relative to the course, both addressed in the design step.

Municipal or County Permitting

Building permits (and sometimes separate electrical/plumbing permits) come from the city or county the property sits in, confirming the design meets building code, setback requirements, and safety-barrier rules. In unincorporated areas, this runs through county permitting rather than a city office; in incorporated cities (including, in the Memorial Villages case, several small independent cities), it runs through that specific municipal office.

HOA Architectural Review

Separately, HOA-governed communities typically require architectural review committee (ACC) or design review committee (DRC) approval, which looks at fence materials, setbacks relative to deed restrictions, and sometimes aesthetic guidelines beyond what the municipal code covers. This is a private community requirement, not a government one, and does not substitute for municipal permitting; most projects need both, not either/or.

Both processes are typically run during the design phase of a project so the pool is not held up mid-construction waiting on paperwork that should have been filed before the first excavation date.

FAQs

Can construction start before HOA approval is finalized?

Not advisably; starting before ACC/DRC sign-off risks being required to modify or even remove non-compliant work, which is why that approval is sought during design, before a build date is scheduled.

Do I need a permit for pool equipment replacement, not just new construction?

Often yes for electrical or plumbing work tied to equipment replacement, depending on the local jurisdiction and scope of work; worth confirming with the specific permitting office rather than assuming a repair is exempt.
